Sick Leave Entitlement in Argentina

Paid sick leave in Argentina includes leave up to 3 months per year if the employee has less than 5 years of seniority, and leave up to 6 months per year if the employee has more than 5 years of seniority. These may be doubled for employees with family dependents.

Maternity leave: 45 days' paid leave prior to - and 45 days' paid leave after - giving birth (paid by ANSES). Paternity leave: 2 days' paid leave.

Annual Leave Entitlement in Argentina

Minimum annual leave entitlement depends on length of service. For employees with less than 6 months of service, annual leave will be 1 day of vacation per worked month. Thereafter, annual leave ranges from 14 - 35 days.

Severance Pay Entitlement in Argentina

Severance is payable in case of unfair dismissal or in case of termination without just cause. Generally, employees receive 1 month’s pay per year of service however this may vary depending on whether a Collective Bargaining Agreement (CBA) is in place.

Termination in Argentina is generally difficult. Termination must be justified and with notice - unless it is through mutual agreement, due to economic factors, the employee has not been fulfilling work, or has performed serious misconduct.
