Sick Leave Entitlement in Ireland

Statutory sick pay (SSP) entitlement for up to 3 days absence a year due to illness or injury will be introduced in 2023. This is due to increase to 5 days in 2024, 7 days in 2025 and 10 days in 2026. 

If the employee is off sick for more than the covered days they can apply to the Department of Social Protection (DSP) for a payment called Illness Benefit if they have enough PRSI contributions (social security contributions).

Parental Leave in Ireland

Maternity Benefit (by State): Maternity benefit paid by State subject to employee’s PRSI contributions at EUR 262 p/wk for 26 weeks (subject to change).  

Maternity Pay: No statutory obligation for employer to pay employee during maternity leave. Terms usually agreed with employee.   

Paternity Leave: 2 weeks. Paternity benefit payable by State subject to employees PRSI contributions.  

Parental Leave: Parents entitled to 26 weeks unpaid leave for each child under 12, subject to modifications for adopted child or child with disability or long-term illness.    

Parent’s Leave: Parent’s Leave is separate to Parental Leave. Parent’s Leave is specifically for parents during the child’s first year.

Adoptive leave: 24 weeks’ leave off work to one parent of the adopting couple, or a parent who is adopting alone.

Annual Leave Entitlement in Ireland

Annual leave entitlement depends on how much time the employee has worked in a leave year.

Severance Pay Entitlement in Ireland

No mandatory severance pay except in cases of redundancy.

Termination in Ireland

Employers must have a fair reason to terminate the employee and follow a fair process. If not, employees may bring a claim for unfair dismissal.
