Sick leave in the Dominican Republic includes compensation provided by the laws relating to accidents at work and Social Security, in cases of illness. For both short-term and long-term sick leave, from the 4th day onwards the Social Security Administration will pay 60% of the salary (only if the employee has a medical certificate issued by a Social Security Administration doctor.)
Maternity: The Dominican Republic’s maternity leave regulations include 7 weeks pre birth and 7 weeks post birth. Employees receive the amount of the maternity benefit as a credit paid by the employer. Employers must give the vacation period after the maternity leave if the mother has the right to it.
Paternity: Paternity leave in the Dominican Republic includes 2 days of paid paternity leave.
Parental: The Dominican Republic has no legal requirement on parental leave.
Employees are entitled to annual paid vacation after a year of continuous service. The length of leave is always 14 days, but the payment depends on years of service by the employee. Between 1 and 5 years worked, an employee is paid an equivalent amount of 14 working days. If more than 5 years of continuous service are worked then the employee is paid an equivalent to 18 working days.
Severance must be paid to the employee within ten days of the termination. If not, the employers must pay a penalty of one day’s salary for every extra day. Only ‘at-will’ terminations have severance, and it depends on the level of seniority/length of service.
Without cause:
Any party to the employment has the right to terminate without specifying a reason (at will). Notice and severance still must be respected.
With cause:
Just causes are listed in the Labour Code. Termination with cause requires 48 hours’ notice to the Minister of Labor. In case the employer fails to provide evidence, they will need to pay severance. In case the employee's grounds for termination are proven, the employee is entitled to receive severance pay.
